Sentenced federal custody and separate pending cases

Do not treat a federal prison commitment as a county-jail bail matter

FCI custody is governed by the federal sentence and BOP authority. If the person has a separate new case, warrant, detainer or writ, counsel should analyze that matter independently. Even if bail or release is available in the separate case, the existing federal commitment can continue to require custody.

Confirm the register number and current BOP institution

Use the Federal Bureau of Prisons inmate locator to verify the current institution and register number before arranging legal correspondence, service or a visit. Federal transfers can change the institution, and the receiving facility's current rules should control legal-access planning.

A practical records check for a sentenced federal client

Identify every active custody basis

1. Confirm the BOP register number and current institution.
2. Identify the federal sentence that presently authorizes custody.
3. Check for a separate case, detainer, writ or transfer order.
4. Evaluate any release in the separate matter against the continuing federal sentence.

Do not equate case resolution with release from BOP custody

A separate matter can be resolved without ending the sentence that keeps the person in federal prison.

Review the controlling federal authority

For release questions, counsel should identify whether the issue is sentence completion, a court order, compassionate release, a writ, a detainer or a separate pending case. Ordinary California bail-posting procedures do not determine release from a federal sentence.

For current agency procedures, check the Federal Bureau of Prisons' official facility information and the BOP inmate locator before a time-sensitive visit, bond posting or document delivery.
